Hierbei konnte die Straf barkeitsvorverlagerung nicht nur rechtstheoretisch, sondern anhand der aktuellen polizeilichen Erkenntnisse praxisnah

Seit 2015 stellt das Phänomen der Geldausgabeautomaten-Sprengungen die deutschen Polizeien vor erhebliche Herausforderungen. Um möglichst frühzeitig strafprozessuale Maßnahmen gegen mögliche Täter treffen zu können, wird in diesem Werk die frühestmögliche Begründung eines An-fangsverdachtes nach § 152 II StPO erarbeitet. Hierbei konnte die Straf-barkeitsvorverlagerung nicht nur rechtstheoretisch, sondern anhand der aktuellen polizeilichen Erkenntnisse praxisnah und anschaulich für einge-setzte Polizeibedienstete herausgestellt werden. In einem ersten Teil werden die aktuellen polizeilichen Erkenntnisse zum Thema dargelegt. Im Weiteren wird die Vorverlagerung der Strafbarkeit für das Herbeiführen von Sprengstoffexplosionen nach § 308 I StGB über den Versuch hinaus erarbeitet. Diese Vorverlagerung kann über das Vorbe-reiten eines Explosionsverbrechens nach § 310 I Nr. 2 StGB sowie die Verabredung zu einem Verbrechen nach § 30 II Alt. 3 StGB erlangt wer-den. Nach der Verknüpfung von den aktuellen Erkenntnissen und der rechtli-chen Lage steht am Ende der Arbeit eine anwenderfreundliche Handrei-chung zum Umgang mit möglichen Tätern von Geldausgabeautomaten-Sprengungen. Dort sind die wichtigsten Tatbestände, die aktuellen polizei-lichen Erkenntnisse sowie eine kurze Handlungsempfehlung zur frühest-möglichen Begründung eines Anfangsverdachtes prägnant und praxisnah dargestellt.
